TERRITORY PLAN

PERFORMANCE OF PROPOSAL AGAINST TERRITORY PLAN REQUIREMENTS

Block 4 Section 12 Gungahlin is zoned CZ1 – Core Zone under the Territory Plan. The block is subject to the Gungahlin Precinct Map and Code and Multi-Unit Housing Development Code. Given the nature of the proposed, only certain parts of the Multi-Unit Housing Development Code applies to this proposal. ​Below is a description of how the proposal addresses the Territory Plan requirements.

GUNGAHLIN PRECINCT MAP AND CODE

The proposed site falls within the Gungahlin Precinct Map and Code where the following controls are relevant to the site. A full assessment of the Gungahlin Precinct Map and Code will be included in the submission of a Development Application stage. 

  • The proposed development performs well against the desired planning outcomes where it provides a range of uses, has activation on the ground floor, provides a safe and vibrant night ime economy and is supported and integrates into the eixtsing public transport. 

  • The site is subject to active frontages in accordance with Element 7.3.

    • The proposed retail and commercial uses on the ground floor allow for an intersting and activated pedestrian realm. 

  • The site is located in Area 1a - Retail Core

  • The site is subject to a height envelope. The site is contained within the height envelope.​

  • The site includes awnings for pedestrian amenity. 

MULTI-UNIT HOUSING DEVELOPMENT CODE

R29 Front Boundary Setbacks

Front boundary setbacks comply with Table A5. Minimum boundary setbacks for corner blocks apply only to the street frontage nominated as a secondary street frontage. If street frontages on corner blocks are of equal length, the minimum setbacks apply only to one secondary street frontage. Chamfers may be included in the secondary street frontage.

  • The development complies with Table A5 and maintains minimum front setbacks and additional setbacks above ground in order to build within the building envelope held within the Gungahlin Precinct Map and Code. 

 

R58 Solar access - apartments

This rule applies to apartments. The floor or internal wall of a daytime living area of not fewer than 70% of apartments on a site is exposed to not less than 3 hours of direct sunlight between the hours of 9am and 3pm on the winter solstice (21 June).

  • The development achieves solar compliance for apartments. 

R59 Privacy

This rule applies to dwellings on the same block. A person with an eye height of 1.5m standing at any point on the extremity of an unscreened element of one dwelling shall not have a direct line of sight into the primary window of any other dwelling. The direct line of sight is a minimum distance of 12m.

  • The development achieves privacy for residents by providing screening to all balconies, restricting the direct line of sight onto adjacent dwellings.
